			<content:encoded><![CDATA[<p>The USCIS will soon offer an E-verify program that will allow individuals to self-check their work authorization status.  The service will allow an individual to self-input information about themselves to determine whether there are any mistakes in a person&#8217;s record.</p>
<p>The e-verify system is a volunteer system that allows employers to verify a new employee&#8217;s work authorization.  However, the system has been plagued by many false positives which have caused needless delays and aggravation for employees (including U.S. citizens) who are eligible to work, but must &#8220;clear their name&#8221; by removing false information.  Additionally, E-verify has given rise to many discrimination lawsuits because employers often do not appropriately use e-verify.</p>

			<content:encoded><![CDATA[<p>The US Supreme Court recently announced that it will hear arguments in <em>Chicanos Por La Causa, Inc. v. Napolitano</em>, 558 F.3d 856 (9th  Cir. 2009), cert. granted sub nom. <em>Chamber of Commerce v.  Candelaria</em>, (June 28, 2009) (No. 09-115).</p>
<p>The case involves Arizona&#8217;s Legal Arizona Workers Act,  which prohibits employers from knowingly or intentionally  employing an unauthorized workers.  At issue in the case is whether the state statute is preempted by federal  immigration laws. The lower  courts upheld the statute, finding that it was not preempted by federal  law.</p>
<p>The Court granted cert on the following issues:</p>
<ol>
<li>Whether an Arizona statute that imposes sanctions on employers who  hire unauthorized aliens is invalid under a federal statute that  expressly &#8220;preempt[s] any State or local law imposing civil or criminal  sanctions (other than through licensing and similar laws) upon those who  employ, or recruit or refer for a fee for employment, unauthorized  aliens.&#8221; 8 U.S.C. § 1324a(h)(2).</li>
<li>Whether the Arizona statute, which requires all employers to  participate in a federal electronic employment verification system, is  preempted by a federal law that specifically makes that system  voluntary. 8 U.S.C. § 1324a note.</li>
<li>Whether the Arizona statute is impliedly preempted because it  undermines the &#8220;comprehensive scheme&#8221; that Congress created to regulate  the employment of aliens. Hoffman Plastic Compounds, Inc. v. NLRB, 535  U.S. 137, 147 (2002).</li>
</ol>
<p>The outcome of this case may significantly alter the landscape of immigration law and how foreign nationals are treated in the United States.</p>

			<content:encoded><![CDATA[<p>The <a href="http://latimesblogs.latimes.com/lanow/2009/12/lancaster-requires-businesses-to-do-immigration-checks-on-new-hires.html" target="_blank">California city of Lancaster</a> will soon require businesses to use the federal government&#8217;s e-verify program.  The e-verify program is a voluntary federal program that is meant to allow companies an easier means to identify newly hired workers who are eligible to work.  The city is threatening the revocation of business licenses for businesses that do not participate.<br />
The city could face serious consequences for its efforts.  First, the constitutionality of a city government forcing participation in an optional federal program remains open for the courts to decide.  I hope the city is prepared to bear the litigation costs of defending itself.  Second, the city&#8217;s mayor is quoted as stating, <a href="http://latimesblogs.latimes.com/lanow/2009/12/lancaster-requires-businesses-to-do-immigration-checks-on-new-hires.html" target="_blank">&#8220;We are working to ensure that all available jobs in our city go to hard-working, law-abiding citizens.”</a> Such a quote, if accurate, makes one wonder if the mayor is aware that there are many foreign nationals who are eligible to work in the United States and that a company&#8217;s refusal to hire eligible workers may result in litigation against a company for discrimination.</p>

<p>The Conrad State 30 program allows for each state to sponsor 30 foreign national medical physicians to work in the United States without having to fulfill the J-1 two-year home residency requirement.  In return, the foreign national physicians agree to work in certain underprivileged areas and medically under-served populations.  These positions are often in areas where very few, if any, other physicians provide medical coverage.</p>
<p>The <a href="http://www.gafnervisalaw.com/practice-areas/investor-immigration/" target="_self">EB-5 investor program</a> allows for foreign national investors to invest in the United States in exchange for obtaining permanent residency.  This program often involves an investment of over one million dollars and requires the investment to create or save ten American workers.</p>
<p>The e-verify program is used by numerous companies to ensure that their workers are authorized to work in the United States.</p>

<p>The USCIS states that, &#8220;<a href="http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=0c9290cc7e115210VgnVCM100000082ca60aRCRD&amp;vgnextchannel=68439c7755cb9010VgnVCM10000045f3d6a1RCRD" target="_blank">[c]urrently, more than 170,000 participating employers at about 650,000 worksites nationwide currently use E-Verify to electronically verify their employees’ eligibility to work in the United States.  Since October 1, 2009, more than 1.6 million employment verification queries have been run through the system.  About 97 percent of all queries are now automatically confirmed without any need for employee action.&#8221;</a></p>
